Belgium Authority Requirements

Since Thailand's Hague Apostille accession enters into force on 28 February 2027, every Belgian Service de l'État Civil / Dienst Burgerlijke Stand, the Office des Étrangers / Dienst Vreemdelingenzaken (DVZ), the Registre national / Rijksregister, the SPF Justice and the SPF Affaires étrangères (Service des Légalisations) accept a single MFA Thailand Apostille in place of the legacy Belgian Embassy légalisation. Common Pitfalls We Eliminate

DABS digital transcription requirements
Since 2019 all civil-status events are recorded in DABS (digital register). Paper transcription is no longer issued. Communes require apostilled+translated documents plus structured XML metadata for DABS upload. Older paper-format translations are rejected — we prepare DABS-compatible deliverables.
Traducteur juré register — commune verification
Communes cross-check the traducteur juré against the SPF Justice national register. Translators not yet migrated to the post-2019 national register (some Tribunal-listed translators from before the reform) are flagged. We work only with national-register-listed translators.
Belgian Embassy 'still required' misinformation
Visa agents at VFS Belgium Bangkok continue requesting embassy légalisation. Since 14 Dec 2024 the MFA Apostille is conclusive; we cite the SPF Affaires étrangères circular if challenged. Insistence is rare but happens 1-2 times per quarter.
Commune de Bruxelles non-resident routing
Belgian citizens not resident in Belgium must transcribe foreign marriages at the commune of Bruxelles (1000), per Art. 31 CODIP. Filing at the parents' commune is incorrect and creates a 4-6 week return-to-sender delay. We confirm residence status before dispatch.

FAQ — Belgium Apostille

Is Belgian Embassy légalisation still required?

No. From 28 February 2027 Belgium accepts the MFA Thailand Apostille directly. The Embassy of Belgium in Bangkok has discontinued légalisation for apostilled Thai documents. The Office des Étrangers, every commune Service de l'État Civil, the SPF Justice and the SPF Affaires étrangères Service des Légalisations treat the MFA Apostille as conclusive authentication.

Do I need a Belgian traducteur juré?

Almost always for in-country filings. Communes (transcription DABS), the Office des Étrangers and DVZ (visa long séjour D, regroupement familial) and SPF Justice consistently require translation by a traducteur juré listed in the national register maintained by the SPF Justice. Embassy/consulate filings overseas sometimes accept Thai court-listed translator certifications. We default to Belgian traducteur juré for any DABS transcription.

What is the validity window of a Thai single-status certificate?

Belgian communes cap acceptance at 6 months from issuance under the Code Civil and DABS practice. For mariage at the commune the certificat de non-empêchement procedure requires the certificate to be ≤6 months old at déclaration de mariage filing, with the marriage occurring within 6 months of the déclaration.

Can I transcribe a Thai marriage in DABS?

Yes under Art. 31 Code de droit international privé. The apostilled and traducteur juré-translated Thai Kor.Ror.3 is filed at the commune of the Belgian spouse's residence, or at the commune de Bruxelles (1000) for non-resident Belgian citizens. DABS digital transcription is typically completed 2-6 weeks after filing; once transcribed the marriage unlocks OE regroupement familial under Art. 40bis.

Does Belgium verify the MFA Apostille digitally?

Yes. SPF Affaires étrangères Service des Légalisations and OE case officers verify Thai Apostilles via the e-Register at consular.mfa.go.th/eapostille (QR or Apostille number lookup). Communes typically rely on document inspection but escalate verification to SPF Affaires étrangères within 72 hours when in doubt. What about naturalisation Art. 12bis CNB?

The MFA Apostille is required on every Thai supporting document (birth, marriage, PCSC, Tor.Ror.14) submitted with the déclaration de nationalité Art. 12bis at the commune. Belgian traducteur juré translation is mandatory.
