Case study: notarising a Power of Attorney issued in Thailand for use overseas
A Power of Attorney signed in Thailand for overseas use must be signed in person before a Notarial Services Attorney registered with the Lawyers Council of Thailand. The signed deed is then legalised at the Department of Consular Affairs and, where the receiving country requires it, certified again at that country's embassy in Bangkok. A standard file usually takes 3–7 working days, excluding embassy queues.
Who this is for: People living in Thailand who need a relative, agent or lawyer overseas to act for them — selling property, closing bank accounts, accepting an inheritance or signing a contract.

Documents you need
- A complete draft Power of Attorney with the granted powers clearly scoped (never open-ended)
- Original passport or Thai ID card of the grantor
- Copy of the attorney-in-fact's passport or ID card, spelled exactly as in their travel document
- Reference documents for the transaction — title deed, contract, account number, share register
- A translation into the destination language where English or Thai is not accepted
Step-by-step process
1. Review the draft and the scope of authority
We confirm the powers actually cover the transaction, that names and document numbers match the destination register, and that an expiry date is stated.
Handled by: Advisory team · Typical time: Same day
2. Sign before the notarial attorney
The grantor presents original identification and signs in person. The attorney certifies the signature, applies the seal and records the certificate number.
Handled by: Notarial Services Attorney · Typical time: 30–60 minutes
3. Translate and certify the translation if required
The deed is translated into the destination country's official language and the translation is certified so the Department of Consular Affairs will accept the file.
Handled by: Translation team · Typical time: 1–2 working days
4. Legalisation at the Department of Consular Affairs
The attorney's signature is legalised. Standard or express counters are available depending on the queue on the day.
Handled by: Department of Consular Affairs · Typical time: 1–3 working days
5. Certification at the destination embassy
Where the receiving country requires a further layer, the file is lodged with its embassy or consulate in Thailand.
Handled by: Destination embassy · Typical time: 1–10 working days, embassy dependent
6. Dispatch to the attorney-in-fact
The completed set is couriered with backup copies and an international tracking number.
Handled by: Our team · Typical time: 2–7 days depending on destination
Common reasons files are rejected
- Signing the deed in advance and bringing it in for certification — the signature must be witnessed by the attorney.
- Powers drafted so broadly that the receiving authority cannot identify the transaction and refuses the deed.
- A single-letter mismatch between the name in the deed and the name in the passport.
- Skipping the Department of Consular Affairs and going straight to the embassy, which returns the whole file.
- Supporting documents that have expired, such as a company affidavit older than six months.
Comparing the available routes
| Option | Use when | Typical time | Note |
|---|---|---|---|
| Notarial certification + Consular Affairs + embassy | The destination still requires the full legalisation chain | 5–14 working days | The safest standard route today |
| Notarial certification + Consular Affairs | The receiving party accepts the Thai MFA certification without embassy involvement | 3–7 working days | Confirm acceptance in writing with the recipient first |
| Thai embassy abroad | The grantor is outside Thailand | Embassy dependent | Requires an appointment and that embassy's own form |
Frequently asked questions
Which language should the Power of Attorney be written in?
Thai or English are both possible, but the receiving party decides. Many European authorities require a translation into their official language produced by a translator they recognise. If you use a bilingual deed, set the two languages in parallel columns so the receiving officer can compare clauses line by line.
Is a Thai notarial attorney the same as a foreign Notary Public?
The function is comparable but the title differs. Thailand has no Notary Public office; certification is performed by a lawyer licensed by the Lawyers Council of Thailand as a Notarial Services Attorney. Overseas authorities generally accept this once the signature has been legalised by the Department of Consular Affairs.
Can someone else bring the document in for me?
No. The grantor must appear and sign in front of the certifying attorney with original identification. Only the later stages — consular legalisation, embassy certification and delivery — can be handled on your behalf.
How long does a Power of Attorney stay valid?
Thai law does not impose a fixed expiry, but most receiving authorities treat a deed older than three to six months as stale. State the purpose and an end date in the deed itself so the recipient can see it is current.
Does Apostille replace these steps?
Apostille, once available for a document type and destination, replaces only the destination-embassy layer. It never replaces the translation or the certification of the translation. Confirm the current scope with the Department of Consular Affairs before planning around it.
What if the recipient rejects the deed?
Ask the recipient for the exact reason in writing — usually scope, spelling or a missing layer of certification. We redraft and re-run the affected step; where the rejection results from an error on our side, the correction is handled at no additional service charge.
