🇨🇦Marry a Canada national in Thailand

Canada has not issued a Certificate of Non-Impediment to Marriage (CNI) since 2013. In its place, the Canadian citizen swears a Statutory Declaration of Marital Status before a Canadian consular officer at the Embassy of Canada to Thailand, 15th Floor, Abdulrahim Place, 990 Rama IV Road, Silom, Bangkok. The current notarial fee is CAD 50 per signature (paid in THB cash at the consular rate on the day, no card payment). Appointments are booked through the consular section's online portal and slots are released two weeks ahead.

The declaration is a one-page document drafted on Embassy letterhead in which the Canadian swears that they are single, divorced, or widowed and free to marry under Canadian law. It is signed in front of the consular officer and notarised on the spot — total appointment time is around 30 minutes. NYC accompanies the Canadian client to the Embassy and provides a pre-filled template in advance, which means the appointment itself usually takes less than 15 minutes at the consular window.

Once issued, the declaration is translated into Thai by an MFA-registered translator (1 business day) and legalised at the MFA Department of Consular Affairs (1–3 business days, or same-day with the THB 800 express fee). Since Thailand's Hague accession on 14 December 2024, the post-marriage Apostille on the Kor.Ror.3 — issued by the same MFA office — is now accepted by IRCC and by every Canadian provincial vital-statistics registry without further consular legalisation.

The Spousal Sponsorship application is filed under the Family Class (R.117) of the Immigration and Refugee Protection Regulations. Most Thai-Canadian couples file outland because (a) the Thai spouse can remain in Thailand or travel internationally while PR is decided, (b) outland refusals can be appealed to the Immigration Appeal Division (IAD), and (c) Manila Visa Office processing is currently 10–14 months — faster than inland Mississauga (12–18 months).

The Canadian sponsor must be 18+, a Canadian citizen or permanent resident, and not in default of any previous sponsorship undertaking or family support order. Unlike the Parent and Grandparent stream, the Spousal Sponsorship does NOT have a Minimum Necessary Income (MNI) requirement — the sponsor signs a 3-year undertaking to support the spouse regardless of income. However, sponsors on social assistance (other than disability) are barred.

The full document package — IMM 1344 Sponsorship Agreement, IMM 5532 Relationship Information, IMM 5669 Schedule A Background, police certificates from every country lived in for 6+ months since age 18, IRCC-approved upfront medical exam by a Panel Physician (in Thailand: Bangkok Hospital, BNH, Bumrungrad, Vejthani), and the apostilled Kor.Ror.3 — is uploaded through the IRCC PR Portal. Government fees total CAD 1,205 (sponsorship CAD 85, principal applicant CAD 545, Right of Permanent Residence Fee CAD 575).

Since the May 2023 IRCC public policy refresh, the Thai spouse can apply for a Spousal Open Work Permit (SOWP) concurrently with the outland PR application, provided they will reside in Canada while PR is processed. The SOWP is filed online at IRCC, costs CAD 255, and is currently issued in 3–5 months. It permits employment with any Canadian employer (other than designated ineligible employers in adult entertainment) without an LMIA, including self-employment.

Once PR is approved, the Thai spouse is issued a Confirmation of Permanent Residence (COPR) document and a single-entry PR visa stamp in their Thai passport at the IRCC Visa Office in Manila — Manila handles all Bangkok-region cases. The spouse must land in Canada before the COPR expiry (typically 12 months from medical exam date) to activate PR.

The PR card is mailed to the Canadian address within 6–8 weeks. After 3 years of physical presence in Canada (1,095 days within any 5-year window) and meeting language and tax obligations, the spouse can apply for Canadian citizenship — typically granted 12–18 months after application.
