THB 400K vs THB 40K route

Route 1: THB 400,000 held in the foreigner's sole Thai account — never a joint account — for 2 months (first) or 3 months (renewal). The balance may drop to no less than THB 200,000 for the 3 months after approval, but must return to THB 400,000 for the remaining year. Route 2: A monthly income letter of THB 40,000 from your embassy; the UK, US and Australia no longer issue these, forcing route 1.

Can I work on this visa?

The Non-O Marriage itself is not a work authorisation, but it is a qualifying visa for a Work Permit. Companies with THB 1M paid-up capital or two Thai employees can sponsor a WP.3 filing at the Department of Employment. NYC offers a combined Non-O + Work Permit package at THB 28,000.

Home visit inspections

Since 2019 several offices (Chiang Mai, Phuket, Hua Hin) conduct random home visits 30-90 days after approval. Officers look for both spouses' personal belongings, shared bedroom and framed family photos. Any 'sham marriage' finding triggers cancellation and a 5-year blacklist.

Divorce or bereavement

You must notify Immigration within 7 days of divorce; the visa is cut to a 7-day departure window, unless you qualify for Non-O Retirement (50+) or a Non-B work track. Widowed spouses may pivot to Non-O for minor children or an eligible alternative visa.

How it works

  1. 1. Register the marriage

    Register at any Thai amphur or MFA-legalise a foreign marriage certificate. NYC handles the Bang Rak amphur filing at no extra fee.

  2. 2. Season THB 400,000

    Open a Thai bank account in your own name and inward-remit THB 400,000 — hold for 2 months (first) or 3 months (renewal).

  3. 3. Convert to Non-O

    Inside Thailand file Change of Type at Chaeng Wattana (THB 2,000). Outside Thailand file Non-O 90-day at your Thai Embassy first.

  4. 4. 1-year extension

    File 30 days before expiry. Your Thai spouse must attend in person for an interview and provide at least 20 in-home photos.

  5. 5. Home visit inspection

    Immigration may inspect the marital home 30-90 days after approval. NYC provides a pre-visit briefing so both spouses are prepared.

FAQ

Does an overseas marriage certificate qualify?

Yes — translate it into Thai, legalise it at the Thai MFA, and present it to Immigration. All Hague/non-Hague marriage certificates are accepted once MFA-attested.

Must my Thai spouse attend Immigration every time?

Year one: yes — both are interviewed. From year two, some offices accept a power of attorney and ID copy in lieu of the spouse's physical presence.

Can the THB 400K sit in my Thai spouse's account?

No — the funds must be in the foreigner's sole account and originate from an inward international transfer (FTT reference on the statement).

Can we combine our balances to reach THB 400K?

No. Immigration only counts a single foreign national's own Thai bank account held in their sole name, so joint accounts, a Thai spouse's account and pooled family funds are all rejected. The money must also be seasoned in that account for the required number of months before the application date.

When can I apply for PR or citizenship?

After 3 continuous years on Non-O Marriage with 3 years of tax filing you may apply for Permanent Residence; after 5 years, citizenship. NYC runs both PR and Naturalisation service lines.
