Is the U.S. Embassy Bangkok authentication still required?
No. From 28 February 2027 the United States accepts the MFA Thailand Apostille directly. The U.S. Embassy Bangkok Notarial Section has discontinued document authentication for apostilled Thai documents. USCIS, NVC, the State Department Office of Authentications and every state Secretary of State accept the MFA Apostille as conclusive evidence of authenticity under Article 3 of the 1961 Hague Convention.
Does USCIS accept Thai court-listed translators?
Yes. 8 CFR §103.2(b)(3) requires any foreign-language document to be accompanied by an English translation 'certified by the translator as complete and accurate, and by the translator's certification that he or she is competent to translate from the foreign language into English.' Our court-listed translator's certification meets this exactly and is accepted at every USCIS Service Center, NVC and consular post worldwide.
How does the Apostille interact with NACES credential evaluation?
Apostille and NACES evaluation serve different USCIS purposes. The Apostille authenticates the signature on a Thai degree certificate — it does not assess U.S. equivalence. For EB-2, EB-3 and H-1B petitions, USCIS additionally requires a NACES-member credential evaluation (WES, ECE, IEE) to confirm U.S. Bachelor's equivalence. NYC Legal coordinates both in parallel: Apostille (5-7 days) plus NACES evaluation (5-7 days).
What if my Thai document is older than 24 months?
USCIS accepts civil-status documents up to 24 months old for I-485 adjustment, but NVC requires within 12 months for immigrant visas and police clearance within 6 months at consular interview. For older documents, the Amphur will reissue from its archive in 1-2 business days at THB 50 per copy. NYC Legal coordinates nationwide reissuance before commencing the Apostille.
Can I use the Apostille for a K-1 fiancé(e) visa?
Yes. The K-1 process at the U.S. Embassy Bangkok requires the beneficiary's Thai police clearance, single-status certificate and (if previously married) divorce decree, each apostilled and translated. Does the Apostille cover the police clearance fingerprint requirement?
The Apostille authenticates the RTP-issued certificate but does not replace the requirement for a fingerprint-based PCSC.
