India-Thailand Apostille Flow — Post-December 2024
India acceded to the Hague Apostille Convention 26 October 2004, effective 14 July 2005. Thailand acceded 25 June 2024, effective 24 December 2024. Since 24 December 2024, the Thailand-India document corridor uses simple Apostille — no Embassy of India Bangkok legalization required (this old requirement was abolished by Indian MEA Notification F.No. AT/424/2/2024 dated 18 December 2024).
Direction Thailand→India: Thai document → MOJ-registered translator (Thai→English) → MFA Department of Consular Affairs Chaeng Watthana Apostille (THB 200 standard or THB 800 same-day express) → courier to India. The Apostilled document is immediately accepted by Indian Ministry of Home Affairs (work visa applications via FRRO), Reserve Bank of India (NRI/business registrations), state-level Marriage Registrar offices, and Indian universities/employers.
Direction India→Thailand: Indian document → Sub-Divisional Magistrate (SDM) or notary public attestation → State Home Department or HRD (for educational docs) attestation → MEA (Ministry of External Affairs) Apostille via Regional Passport Office or BLS International e-Apostille center, INR 50/document → courier to Thailand. The Indian Apostille is recognized in Thailand from 24 December 2024 onward. Older Indian documents Apostilled before Thailand's accession are also valid (no re-Apostille needed — Apostille has no expiration if document content is valid).
Employment Visa & Work Permit Categories
Indian Employment Visa (E-Visa for employment) is the standard skilled-worker route for foreigners. Requirements: bona fide Indian employer offer letter + Apostilled degree + 2+ years relevant work experience + minimum annual salary USD 25,000 (~INR 21 lakh) — this threshold is strictly enforced; below-threshold offers are rejected by Embassy of India. Exception: language teachers, ethnic cuisine chefs, and certain specialist roles have lower thresholds. Visa duration matches employment contract up to 5 years initial + extensions.
Application via Indian Visa Online portal (indianvisaonline.gov.in) → fee USD 250-500 depending on duration → Embassy of India Bangkok (Sukhumvit Soi 23) collection. Within 14 days of arrival in India: register with FRRO (Foreigners Regional Registration Office) at destination city — Mumbai, Delhi, Bangalore, Chennai, Hyderabad, or Pune are most common. FRRO registration is free if visa duration is over 180 days. Re-entry permits issued automatically.
Alternative routes: (1) Business Visa — for B2B meetings, contract negotiations, business setup activities; multi-entry 1-5 years, USD 200-700, no minimum salary requirement but no employment allowed. (2) Project Visa — for foreign engineers/technicians working on specific Indian projects (power plants, infrastructure), employer files application, visa tied to project duration. (3) Research Visa — for academic researchers, 5-year duration, requires Indian university/institute affiliation letter.
OCI (Overseas Citizen of India) — For Thai Spouses & Persons of Indian Origin
OCI (Overseas Citizen of India) is a lifetime multi-entry visa + work permit + property ownership right, available to: (1) Foreign spouses of Indian citizens or OCI holders married for 2+ years. (2) Persons of Indian Origin (PIO) — foreign citizens whose parents/grandparents/great-grandparents were Indian citizens. (3) Minor children of OCI holders. (4) Foreign citizens who were eligible to be Indian citizens on 26 January 1950 (Indian Constitution adoption date) or thereafter.
Thai spouses of Indian citizens — most common Thai OCI route. Required documents: Apostilled Thai marriage certificate, Apostilled spouse's Indian passport + birth certificate, applicant's passport + photos + biometrics, marriage proof (joint bank account, joint lease, family photos), no-criminal-record certificate. Application fee USD 275 (Embassy Bangkok submission). Processing 8-12 weeks. OCI benefits: lifetime visa-free entry to India, work + study + business + property ownership rights identical to Indian citizens (except: cannot vote, hold elected office, or buy agricultural land).

Business Setup — Thai Investment in India
Thai businesses entering India have 4 main structures: (1) Liaison Office — non-commercial representative office for market study, INR 0 minimum capital, RBI approval required, 3-year renewable validity. (2) Branch Office — commercial activities (export/import, professional services), parent company profitable last 5 years, RBI approval. (3) Project Office — for specific contracted projects (engineering, construction), tied to project duration. (4) Wholly-Owned Subsidiary (Private Limited Company) — most common, full operational flexibility, registered with Ministry of Corporate Affairs (MCA).
Pvt Ltd subsidiary requirements: minimum 2 directors (1 must be Indian resident — can be nominee, ~INR 50,000-100,000/year for nominee service), minimum 2 shareholders (can both be foreign), minimum paid-up capital INR 100,000 (~THB 42,000) for service companies, no upper limit. Documents requiring Apostille: Thai parent company DBD certificate + Articles of Association + last-year audited financials + board resolution authorizing Indian subsidiary + Thai director passports + Thai director address proof. Registration via MCA portal — fees INR 7,000-15,000 depending on capital. Processing 7-15 days. Annual compliance: ROC (Registrar of Companies) annual filing + GST registration + income tax filing.
FDI rules: Most sectors are 100% FDI under Automatic Route (no government approval needed) — IT services, manufacturing, e-commerce B2B, hotels, tourism, education. Restricted sectors requiring Government Approval Route: telecom (49% auto + 100% with approval), defense (74% auto + 100% with approval), broadcasting, multi-brand retail (51% with approval).
