Kenya: new Hague Apostille member (Jan 2025)

Thai documents bearing a Thai MFA Apostille are accepted directly by eCitizen, Kenya Revenue Authority (KRA), Registrar of Companies (Sheria House, Nairobi), Department of Immigration Services and Marriage Registrar under Marriage Act 2014.

Kenya-specific pitfalls

2) KRA PIN must be obtained within 30 days of arrival (for work permit holders) — penalty KES 20,000 + 1%/month of tax due.

3) Marriage Act 2014 recognises 5 marriage systems — choose in advance; Civil Marriage at Sheria House requires 30-day Notice; Customary/Islamic faster but limited to the same ethnic/religious group.

4) Class D Work Permit requires proof that no Kenyan can fill the role (Labour Market Test); Class G Investor must transfer ≥USD 100,000 to Central Bank of Kenya first.

5) Thai Apostille is valid immediately — no transitional period; Kenya has clearly stated it accepts documents from all Hague members from 14 January 2025.

The Embassy or MOFA Nairobi route is not required, except in rare cases (e.g. criminal court use in certain counties) where the judge requests additional certification.

What language must documents be translated into?

English is the primary official language (Kiswahili being the second, under Constitution 2010 s.7). English translations by MFA Thailand–registered translators are accepted directly by most agencies. Some (KRA, Marriage Registrar) request a Notary Public Kenya re-certification at KES 2,000–5,000/page.

What does Company Registration require?

Business Registration Service (BRS, Sheria House Nairobi) requires: (1) Form CR1; (2) Apostilled Memorandum & Articles of Association; (3) Apostilled Director ID/Passport; (4) Registered Office Address in Kenya; (5) ≥1 local Director (Kenyan resident). Total THB 5,500–8,500 + BRS fee KES 10,650 (~THB 3,200); 8–12 business days.

How is a KRA PIN obtained?

Kenya Revenue Authority issues a Personal Identification Number via iTax portal. Required: (1) Apostilled passport copy; (2) Alien ID Card (for residents) or Work Permit; (3) Thai Tax Residency Certificate (uses Thailand–Kenya DTA 2010, reducing withholding from 25% to 15%). No fee; 1–3 business days online.

Class D vs Class G Work Permit?

Class D (Specific Occupation): for skilled workers in a defined profession; the Kenyan employer must satisfy a Labour Market Test. Fee USD 2,000/year; valid 2 years. Class G (Investor): requires ≥USD 100,000 transferred to Central Bank of Kenya first + Business Plan + Tax Compliance. Fee USD 3,000/year; valid 2 years; renewable.
